Deprivation of Liberty Safeguards (DoLS)

**3 hour On line -Seminar**

 This course is aimed operational staff who have some working knowledge of the Mental Capacity Act 2005 and are working with adults/young people, whose capacity to make particular decisions (at a particular time) may be questioned. The focus of the 3 hour programme is to provide an opportunity to explore the operational practice requirements of the Mental Capacity Act 2005 and the Deprivation of Liberty Safeguards by undertaking a detailed exploration of recent change of legislation ( including requirements under Coronavirus Legislation) case law and associated statutory and local guidance. This is  aimed  at all professionals and aims to exlore Deprivation of Liberty in a range of settings.

 

Programme Aim:

To assist participants to demonstrate compliance in their practice approach, of their statutory duties and responsibilities in regard to mental capacity, deprivation of liberty safeguards( DoLS)  including revised legislation (Covid-19) and case law and local policy. The programme will build on current knowledge and experiences of participants to enhance effective practice approaches in preparation for the forthcomeing Liberty Protection Safeguards (LPS) .

 

Learning Outcomes:

The objectives of the programme are to provide participants with opportunities to;

  • Understand the legal requirements, roles responsibilities and expectations of the Deprivation of Liberty Safeguards and the link to Human Rights Act.
  • Refresh understanding of the fundamental principles, expectations and requirements of the Mental Capacity Act 2005 and the Deprivation of Liberty Safeguards, including refreshing knowledge on assessment process.
  • Refresh operational understanding of decision makers and decision making, drawing out the concept of best interests to understand what is required within operational practice when making best interest decisions especially when Adults Liberty may need to be deprived in their Best Interest.
  • Explore how the role of the independent Mental Capacity Advocate (IMCA) operates in practice and when an IMCA must be appointed.
  • Explore the role of the Court of Protection, its function to contribute to decision making and its role in safeguarding people who may lack capacity to make certain decisions for themselves in relation to where they live or the care and treatment they require.
  • Have clarity on the DoLS authorisation process for Hospital and Care Homes and understand Community DoL and DoLS and why the S matters.

Terms:

  • Course fees must be paid prior to attending the session
  • Joining instructions will be issued the day prior to the course
  • Certificate of virtual attendance will be issued ( this is not a certificate of competence )
